    Ethics & Attorney-Client Privilege for HR Professionals

    HR professionals often handle sensitive workplace issues that require discussions with outside counsel and, sometimes, retaining of outside counsel to perform investigations into employee complaints or conduct. Understanding an HR professional’s own ethical responsibilities and the ethical responsibilities of assigned legal counsel is critical to protecting both the organization and its employees during and in the aftermath of these engagements.

    This presentation will include rules but also case study reviews and hypotheticals based on real cases.

    Following this presentation, attendees will be able to:

    1. Understand the Code of Ethical and Professional Standards Applicable to HR Professionals — Learn SHRM’s guidance on ethical leadership, fairness and justice, and conflicts of interest to ensure ethical decision making.
    2. Define Attorney-Client Privilege and Conflicts of Interest in HR Contexts – Learn how attorneys define the “client” and scope of engagement in employee-employer matters and how to preserve privilege.
    3. Understand the Scope of Attorney Engagement – Explore strategies and models for engaging with outside counsel to mitigate legal risks and ensure an ongoing positive working relationship.

    **We will also be swearing in our new Board Secretary during this meeting and other board members will take the oath of office for their new positions.



    Speaker:  Joshua Schwartz, Partner, Barley Snyder

    Josh is a partner in the firm’s Litigation and Employment practice groups working primarily in employment counseling and litigation, labor law and workers’ compensation. He also serves as the firm’s general counsel. Josh represents public and private employers in litigation matters, administrative agency investigations, labor arbitrations and commercial litigation.

    •  Pre-registration required by emailing Wendy Button by midnight on Thursday, May 7th.  Payment instructions will be given upon registering.
    • The Chapter pays for the headcount given to BCC the Friday prior to a meeting.  Cancelations of prior registration must be received by midnight on Thursday, May 7th to avoid invoice for the meeting fee.
    • No refunds or credits will be issued for cancelations after midnight on Thursday, May 7th or no-shows.
    • Doors open at 7am for check-in and networking.  
    • Meeting begins at 7:30
